FALCIANI fu il delinquente che RUBO' la lista dei clienti della banca svizzera HSBC (dove lavorava) e li vendette anche alle autorita' europee ....La corte di giustizia di Bellinzona lo ha trovato colpevole ....che sia chiaro....FALCIANI e' un criminale e non un santo....e come tale va trattato..
Herve Falciani, a former bank employee who took client data from HSBC Holdings Plc’s Geneva unit, was found guilty of corporate espionage and given a five-year prison sentence by a Swiss court
The decision was read out Friday at the Federal Criminal Court in Bellinzona by Judge David Glassey.The “significant criminal energy” Falciani put into his efforts to pass on the bank data to foreign third parties, showed “a total absence of scruples,” the judge said.
“He’s a thief and a liar,” Laurent Moreillon, HSBC’s lawyer, told reporters after the hearing. Falciani’s argument that he was a whistle-blower was “pure invention and is a lesson to anyone who might try the same thing,” he said.
HSBC said that the bank had always “maintained that Falciani systematically stole clients’ information in order to sell it for his own personal financial gain.”
“The court heard that he was not motivated by whistle-blowing intentions and that this was not a victimless crime,” the London-based bank said in a statement.
OVVIAMENTE...SE UNA PERSONA E' CONSIDERATO CRIMINALE DA UNA CORTE DI GIUSTIZIA...E OGGETTO DEL CRIMINE SONO DEI DATI CHE POI SONO STATI VENDUTU AL FISCO DI ALTRI PAESI..E' EVIDENTE CHE IL FISCO DI ALTRI PAESI SI SIA SPORCATO LE MANI E SIA DA CONSIDERARE ANCHE LUI ALLA STREGUA DI UN CRIMINALE ....(COME LO SONO I COSIDETTI RICETTATORI CHE AIUTANO I RAPINATORI)...MA QUESTA E' UN'ALTRA STORIA..

In realtà c'è da aggiungere che lui era un criminale già da prima per le sue attività nella banca, quindi sarebbe più corretto vederlo come un pentito. Per la questione stati il discorso a mio parere posto così è riduttivo, anche perchè allora se dovessimo valutare così tutti i casi simili dovremmo direttamente chiudere tutti i servizi segreti civili e militari.
La mia opinione su questi atti di portata storica è che i concetti di giusto e sbagliato, legale o illegale diventano così evanescenti ed insignificanti da valere più che altro come pro forma. L'unico ragionamento che tiene è: è successo, sappiamo che può succedere di nuovo, ingegniamoci per proteggerci.
secondo me è colpevole HSBC
se io mi rivolgo a MSFT e si scopre che uno dei dipendenti è un ladro di segreti industriali che approfitta della sua posizione in MSFT per impossessarsi dei miei archivi informatici, ne risponde MSFT che non ha garantito la lealtà e correttezza del suo dipendente. Io il contratto lo avevo con MSFT, se lei ha dipendenti criminali ne deve rispondere lei.
